CONFORMITY OF INSPECTIONS

The inspection process was conceived in such a way that the procedure and evaluation steps are uniform, in order to guarantee the conformity of inspections.

ANIMA-Québec ON SITE

Following a complaint, a report, or an assignment, as soon as the ANIMA-Québec inspector arrives at the premises, he shows his identification card that indicates he is a person authorized to proceed with the inspection. On site, the inspector will visit the establishment in an open and transparent way. By doing so, the animals’ owner or guardian is clearly informed on the elements that need to be modified in order to be compliant with the law. During inspections, all of the elements of Division IV.1.1 of the Animal Health Protection Act are considered, namely: habitat, transportation, care, water, food, cleanliness, and safety of the setting.

With these elements in mind, an inspection grid was designed. This grid is used in its entirety in the event of a visit, regardless of whether the visit was made following a complaint or not. The inspector evaluates the various elements according to the risk they pose towards the safety or welfare of the animals.

The report is completed with the inspector listing the pertinent facts that were observed.

FOLLOWING THE INSPECTION

A copy of the inspection report is sent to the animals’ owner or guardian, accompanied by a personalized list of recommendations. These recommendations are added to the notice of non-compliance that is left on site in certain cases.

The notice of non-compliance, as indicated by its name, officially informs the owner or guardian of what is putting their establishment or practices in violation of the law. This notice sets the deadline by which the situation must be restored and identifies the corrective action in order to conform with the law. A follow-up inspection is made once the deadline outlined in the notice is reached.

In the majority of cases, the improvements needed are done within the given deadline. If not, the inspector is obliged to write up an offence report, which will then be transmitted to the Minister of Justice in order to carry out a prosecution. If the inspector judges that the risk for the safety and welfare of the animals is too elevated, he has the power to seize the animals.

Only the inspector’s written report, the letter of recommendations, and, when necessary, the notices of non-compliance, are sent to the operators of the establishment inspected. In the best-case scenario, we inform the owner or guardian that no elements were found that could endanger the animals and that the safety and welfare of the animals were respected while doing the inspection.
